Estate Disputes

If you’ve been left out of a Will or feel that inadequate provision has been made for you in a Will then you need to speak to us about your rights to make a claim under Part IV of the Administration and Probate Act (Vic.)

We will meet with you, obligation free, to discuss your circumstances and we will advise you as to whether you are eligible to make a claim and your likely success.

There have been a lot of changes in this area of law in recent years and it’s important to get the right advice.  It’s also important not to leave it too long.  You have 6 months from the date of the Grant of Probate in which to lodge a claim.  Waiting longer means that you will need to seek leave from the Court in order to lodge your application.

Alternatively, if you are the executor of an estate facing a claim against the estate, we can provide you with the assistance you need to defend the claim.
